Terms & Conditions

COVERAGE GUARANTEE ASSOCIATION, INC.  (CGA)  hereby agrees to reimburse the applicant/member named on this Service Contract, up to the specified maximum value if any Hole-In-One  (as defined by the USGA Rules of Golf) occurs on the date(s) and the target hole(s) as specified.  Such payment shall be subject to the following Service Contract Warranties and Variable Tournament Conditions. This is not an insurance policy, but a contractual obligation between CGA and the Organization named on this agreement.

A.  BEFORE EVENT
1.  PAYMENT - A valid and collectible event fee is the basis of coverage.  CGA must receive a check or credit card payment prior to the day of the tournament.  Contract is null and void unless a valid check or credit card payment is received by CGA, Inc. prior to the date of the event.

2. CONFIRMATION - Only a signed and completed CGA application received prior to the tournament date will supersede prior communications of terms and conditions.  Your canceled check serves as your receipt/confirmation.

3.   SPONSOR – Applicant/member agrees not to disclose the existence of this contract by public announcements or publicly distributed materials. However, it is the sponsors responsibility to convey the tournament rules herein to the participants.

B.  DURING EVENT

1. WITNESSES - MANDATORY: All target hole witnesses must be stationed at the green.   All witnesses must be tournament non-participants, age 18 or over and appointed by the applicant/member  as follows:  Prizes:  $1,000 up to $19,999 - one witness; $20,000 up to $50,000- two witnesses; $50,001-$99,999-two witnesses (one of which must be a PGA Certified Golf Professional); $100,000 to  $1,000,000- two witnesses one of which must be a PGA certified Golf Professional, in addition to a video tape.  Waivers to these target hole witness provisions are permissible whenever network or cable television video tape of entire target hole activity is available to CGA or a CGA designated representative is present at target hole at all times.   

2. YARDAGE - The target hole(s) will measure from teeing ground to flagstick no less than the specified yardage located in the Tournament Information section of the Contractual Liability Agreement.  The yardage on the additional Par 3’s, for which ancillary prizes are provided, must be set at actual scorecard yardage or longer;  minimum yardage for extra prize holes is 135 yards for men and 120 yards for women.  Women golfers must shoot within 15 yards from the designated men’s tee on the target hole. CGA is not liable for any prize if yardage is not set to contract specifications.

3. SHOTS  - No practice shots or mulligans are permitted.  Each category of authorized number of shots is permitted only during the stipulated round(s) of the named event on the date(s) covered.   No past or present training, club, or touring professional golfers will be qualified contestants unless approved in writing by CGA, Inc prior to the event.

4. ELIGIBILITY - A HOLE-IN-ONE must occur by an officially registered eligible participant.

5. PRIZE RESTORATION  -  The maximum Prize Value is restored automatically to its original amount for each and every Hole-In-One occurrence during the covered event.  Prize Values of $50,000 and greater have no automatic prize restoration unless approved in writing by a CGA executive.

6. COVERAGE GUARANTEE ASSOCIATION, INC. (CGA) has provided ancillary prizes to enhance the tournament in which coverage is provided.  These prizes must be placed upon the exact holes as indicated in this Contractual Liability Agreement.

7. TARGET HOLE - Only one predesignated hole may be used on the target hole green.  Nine (9) hole courses must specify which hole(s) will be eligible during the official covered round.  Indemnification does not apply unless prize is offered on the EXACT target hole as specified in this Service Contract.  Holes designated 1-9 would be considered front side, and holes 10-18 the back side of a nine-hole course.  (Minimum yardage is 135 yards.)

8. PIN PLACEMENT - The pin placement may not be positioned in such a way that the golf ball funnels into the hole.  During consecutive day tournaments, pin placement must be relocated each day.        

9. CGA will cover the indemnified interest only for the applicant/member.

10. AWARDING OF PRIZE:  Prize should not be awarded until verification procedure is completed.  If prize is awarded before verification procedure is complete, Sponsors do so at their own risk.

COMPLIANCE WITH THESE RULES IS REQUIRED TO CLAIM PRIZES.

C.  AFTER EVENT

1. CLAIM NOTIFICATION - Immediate telephone notice by member to the claim department of CGA will be reported no later than the first business day after the event.

2. PROOF OF CLAIM - The following documentation will be furnished to CGA by the applicant/member as proof of a Hole-In-One claim:

    a.  Attested statements by target hole witnesses (per #B-1 above), the successful Hole-In-One Maker
         and statement of resident pro and all playing partners, (these forms will be furnished by CGA).  

   b.  A signed and completed scorecard of the Hole-In-One Maker.

   c.  Certified copy of Tournament Pairing Sheet by the golf course professional or tournament director,
          their amateur or pro status and number of shots allowed.

   d. Verification statements must be returned to CGA by the applicant/member within 30 days of
         hole-in-one to claim prize.

    e.  Copy of local newspaper article announcing hole-in-one made (if applicable).

3. COVERAGE GUARANTEE ASSOCIATION, INC.   (CGA)  reserves the right to substitute ancillary prizes of the same type and/or equal value or greater value.

4. DISPUTED CLAIMS -  CGA acts specifically in behalf of the applicant/member named on this Contractual Liability Agreement and specifically not as an agent of any competitor in a tournament in which CGA provides coverage.  This agreement is subject to arbitration.  Sponsor agrees that resolution of any dispute will be by binding arbitration under the Indiana General Arbitration Act.  The site of any arbitration will be St. Joseph County, IN with each party liable for their own attorney’s fees. The terms and conditions of this contract will be interpreted, construed and controlled by the law of the State of Indiana, and the Contractual Liability Agreement applicant/member and any third-party beneficiary of this contract will be bound there by.

5. INVESTIGATION - Upon receipt of Proof of Claim, CGA may conduct a reasonable investigation including but not limited to requiring the applicant/ member to produce the witnesses(see B-1), the Hole in one-Maker, and/or resident pro for a polygraph examination as a condition to  payment of the claim if in the sole opinion of CGA  such an examination is warranted by the facts.  Investigation of claims will not begin until all required information(see C-2) has been received.

6. FRAUDULENT CLAIMS - If there is a dispute regarding validity of hole-in-one, a polygraph examination may be administered.  If deception is noted in polygraph examination, the examinee is liable for all cost.  If the polygraph examination is not passed, the prize will not be awarded.  The finding of examiner is final.     

7. CGA is not liable for hole-in-one prizes, when signs are not removed promptly following the tournament.

VARIABLE TOURNAMENT CONDITIONS

Specified tournament data pertaining to a change in number of shots, hole yardage, dates, prize value, or weather conditions requiring postponement or cancellation REQUIRE NOTIFICATION TO CGA PRIOR TO THE START OF EVENT.  Telephone messages are recorded 24 hours a day, 7 days a week at the numbers listed on this Contractual Liability Agreement.  You may also communicate any changes in required coverage via FAX to:  (574) 271-1747.  Any premium adjustments will be billed to the member after the event.

* NUMBER OF SHOTS - If the number of shots is overstated or understated, CGA, Inc. must be notified by the last business day prior to the commencement of the golf tournament.  The understatement of participants may result in the delay of claim process and/or possible claim denial.  If CGA is not notified prior to the event, there will be no refund or credit for the overstatement of players.

WEATHER CONDITIONS
Assuming no shots were taken on the target hole(s), a full 100% refund will be made if tournament is canceled due to inclement weather preventing play, or this Contractual Liability Agreement will be amended to a rescheduled rain date without additional charge. Any changes due to inclement weather require notification prior to the start of the event.   If signs are shipped for a tournament which has been canceled and not rescheduled, a $75.00 administrative fee will be applied to cover shipping and handling.
